Definition of “Events”

For the purposes of these Terms and Conditions, an “event” refers to any service, presentation, speech, webinar, workshop, course, meeting, consultation, mentoring session, discovery phone call, podcast recording session, function, conference, and/or any service which is facilitated, delivered, or presented by person who is representing Threesticks Pty Ltd either via telephone or other audio means, video or other visual means, and/or in-person.

Definition of “Products or Services”

For the purposes of these Terms and Conditions, a product or service refers to any presentation, speech, webinar, workshop, course, meeting, consultation, mentoring session, discovery phone call, podcast recording session, function, conference, and/or any service which is facilitated, delivered, or presented by person who is representing Threesticks Pty Ltd either via telephone or other audio means, video or other visual means, and/or in-person.

Products or services also refers to any written documents, audio recordings and video recordings.

Website Terms

By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

General Conditions

We reserve the right to refuse service to anyone for any reason at any time.

Public Events – Cancellation and refund policy for face-to-face / live in-person.

“Events” under this section is as defined previously in these Terms and Conditions. It takes a lot of time and effort to organise our events. We understand that things come up which prevent events from proceeding as planned and we will work with you where we can and we ask that our customers respect our cancellation policy.

If we cancel the event for any reason:

  • We will notify you in writing via the email address you provided.

  • You will have the option to move to another available date, or receive full refund of the monies paid to Threesticks only.

  • Threesticks will not provide any compensation for any other expenses incurred by the customer including and not limited to information technology, travel costs, accommodation, lost income / wages etc.

If you cancel due to circumstances relating to COVID-19:

  • Cancellations must be writing and emailed to hello@threesticks.com.au prior to the scheduled start of the event.

  • We believe in goodwill and in good humans and will trust that your cancellation is due to COVID-19.

  • If you are unable to attend due to COVID-19 because you have contracted COVID-19 and are isolating, have been advised to isolate by your healthcare provider, or have been ordered to isolate in line with National or State Government guidelines, we will give you an option to move to another available event date, or give you a full refund of the monies paid to Threesticks only.

  • Threesticks will not provide any compensation for any other expenses incurred by the customer including and not limited to information technology, travel costs, accommodation, lost income / wages etc.

If you cancel for any other reason:

  • Cancellations must be writing and emailed to hello@threesticks.com.au prior to the scheduled start of the event.

  • If you cancel up to 30 calendar days of the event date, we will give you a full refund.

  • If you cancel up to14 calendar days of the event date, we will give you a refund minus a $110 (inclusive of GST) administration processing fee. If the event fee is less than $100 (inclusive of GST), there are no refunds.

  • If you cancel within 10 calendar days of the event, there are no refunds.

  • We may, at our discretion, and if there is availability, enrol you into another event.

  • Threesticks will not provide any compensation for any other expenses incurred by the customer including and not limited to information technology, travel costs, accommodation, lost income / wages etc.

Public Events – Cancellation and refund policy for virtual /online events.

“Events” under this section is as defined previously in these Terms and Conditions. It takes a lot of time and effort to organise our events. We understand that things come up which prevent events from proceeding as planned and we will work with you where we can and we ask that our customers respect our cancellation policy.

If we cancel the event for any reason:

  • We will notify you in writing via the email address you provided.

  • You will have the option to move to another available date, or receive full refund of the monies paid to Threesticks only.

  • Threesticks will not provide any compensation for any other expenses incurred by the customer including and not limited to information technology, travel costs, accommodation, lost income / wages etc.

If you cancel for any reason:

  • Cancellations must be writing and emailed to hello@threesticks.com.au prior to the scheduled start of the event.

  • If you cancel up to 30 calendar days of the event date, we will give you a full refund.

  • If you cancel up to 14 calendar days of the event date, we will give you a refund minus a $55 (inclusive of GST) administration processing fee. If the event fee is less than $55 (inclusive of GST), there are no refunds.

  • If you cancel within 10 calendar days of the event, there are no refunds.

  • We may, at our discretion, and if there is availability, enrol you into another event.

  • Threesticks will not provide any compensation for any other expenses incurred by the the customer including and not limited to information technology, travel costs, accommodation, lost income / wages etc.

Private Events – Cancellation and refund policy for face-to-face / live events.

“Events” under this section is as defined previously in these Terms and Conditions. We understand that things come up which prevent events from proceeding as planned and we will work with you where we can and we ask that our customers respect our cancellation policy.

If we cancel the event for any reason:

  • We will notify you in writing via the email address you provided.

  • You will have the option to move to another available date, or receive full refund of the monies paid to Threesticks only.

  • Threesticks will not provide any compensation for any other expenses incurred by the customer including and not limited to information technology, travel costs, accommodation, lost income / wages etc.

If you cancel due to circumstances relating to COVID-19:

  • Cancellations must be writing and emailed to hello@threesticks.com.au prior to the scheduled start of the event.

  • We believe in goodwill and in good humans and will trust that your cancellation is due to COVID-19.

  • If you are unable to proceed with your event due to COVID-19 and are required to adhere to National or State Government guidelines, we will work with you to either; 1) reschedule the event date to the next practical and mutual availability; or 2) if practical and does not compromise the integrity and the quality of the event we will deliver the event virtually via videoconference; or 3) give you a full refund of the monies paid to Threesticks only.

  • Threesticks will not provide any compensation for any other expenses incurred by the customer including and not limited to information technology, travel costs, accommodation, lost income / wages etc.

If you cancel for any other reason:

  • Cancellations must be writing and emailed to hello@threesticks.com.au prior to the scheduled start of the event.

  • If you cancel up to 30 calendar days of the event date, we will give you a full refund.

  • If you cancel up to14 calendar days of the event date, we will give you a refund minus a $330 (inclusive of GST) administration processing fee. If the event fee is less than $330 (inclusive of GST), there are no refunds.

  • If you cancel within 10 calendar days of the event, there are no refunds.

  • Threesticks will not provide any compensation for any other expenses incurred by the customer including and not limited to information technology, travel costs, accommodation, lost income / wages etc.

Consulting Services – Cancellation and refund policy

“Consulting Services” under this section is defined as any service which has not already defined in “Events” or “Products or Services” previously in these Terms and Conditions. Threesticks Pty Ltd will be explicit in their communications in identifying Consulting Services to the customer. Consulting Services could include, and is not limited to the following services; business coaching; personal coaching; business development; product development; and service development.

We understand that things come up which prevent consulting services from proceeding as planned and we will work with you where we can and we ask that our customers respect our cancellation policy.

If we cancel the service for any reason:

  • We will notify you in writing via the email address you provided.

  • You will have the option to reschedule the service, or receive full refund of the monies paid to Threesticks only.

  • Threesticks will not provide any compensation for any other expenses incurred by the customer including and not limited to information technology, travel costs, accommodation, lost income / wages etc.

If you cancel for any reason:

  • Cancellations must be writing and emailed to hello@threesticks.com.au prior to the scheduled start of the consultation service.

  • If you cancel up to 30 calendar days of the scheduled start of the consultation service, we will give you a full refund.

  • If you cancel up to14 calendar days of the scheduled start of the consultation service, we will give you a refund minus a $330 (inclusive of GST) administration processing fee. If the scheduled start of the consultation service fee is less than $330 (inclusive of GST), there are no refunds.

  • If you cancel within 10 calendar days scheduled start of the consultation service, there are no refunds.

  • Threesticks will not provide any compensation for any other expenses incurred by the customer including and not limited to information technology, travel costs, accommodation, lost income / wages etc.

Content

The Customer agrees that system, content, materials, and resources including, but not limited to, any intellectual property, documents, research papers, audio and visual media, written media, articles etc used by Threesticks Pty Ltd during their Consulting Service is not exclusive to the customer. Threesticks Pty Ltd maintains the right to use identical or similar system, content, materials, and resources to deliver consulting services, courses, workshops and learning development events.

Accuracy Of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Optional Tools

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms and Conditions.

We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms and Conditions.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Photography, Video Footage, Media and Marketing

Threesticks Pty Ltd might take photographs, video footage, audio recording, or other media before, after and during courses, events and functions. This media could be used for marketing purposes across platforms including and not limited to internet, print and radio. Please advise our team via hello@threesticks.com.au or advise a Threesticks Pty Ltd staff member on the day of the course, event or function if you do not agree to being included in any marketing.

Threesticks Pty Ltd gives permission for any customer / participants in our courses, events and functions to take photos, video footage of no longer than 120 seconds, and audio footage of no longer than 120 seconds for use on their personal social media platforms only. We request that you “tag” our online social media profiles including @rheamercs and @threesticks.training and @the.intelligentrebellion when posting.

Threesticks course content and website content is protected under Copyright Law.

Threesticks does not give permission for any course content to be reproduced, replicated or distributed without prior written consent. This consent can be requested via email hello@threesticks.com.au.

Photography, Video Recording and Footage relating to online / virtual courses

Threesticks Pty Ltd might take photographs, video footage, audio recording, or other media before, after and during courses, events and functions. This media could be used for marketing purposes across platforms including and not limited to internet, print and radio. Please advise our team via hello@threesticks.com.au or advise a Threesticks Pty Ltd staff member on the day of the course, event or function if you do not agree to being included in any marketing.

It is not Threesticks’ usual practice to release the entirety of recordings of online events, courses or workshops to customers / participants. Consideration to release entire video recording of online courses and events will be at our discretion and will only be given to customers who book private events. An agreement in writing between Threesticks Pty Ltd and the customer / participant is required prior to the course / session. Release of full recordings is done in good faith between the customer and Threesticks Pty Ltd.

The recording / video will be uploaded to either YouTube, Vimeo, other online platform and the customer / participant will be provided with access via a weblink. Access will be given during an agreed timeframe of no longer than six calendar months from the date of the course / event / function. By accessing the video, the customer / participant agree to the following terms:

  1. The customer will pay an additional fee to access the recording. The fee will be determined by Threesticks Pty Ltd.

  2. This video recording and the course content within is protected under copyright to Threesticks Pty Ltd 2021 & Rhea Mercado and remains the property of Threesticks Pty Ltd & Rhea Mercado.

  3. The video recording is released in good faith between the Threesticks Pty Ltd and the customer / participant.

  4. The video recording is released for private internal company use only and it is forbidden to be share it with any other business and/or company and/or individual.

  5. This video recording will not be available for download.

  6. This video recording will not to be made public by the customer / participant or any other business and/or company and/or individual affiliated with customer / participant.

  7. Should the customer / participant want to use the video recording for purposes other than internal review – please contact hello@threesticks.com.au

  8. The video recording will be made available for six months after the date of upload.

  9. The individuals featured in the video recording have provided their consent to be filmed and recorded as a part of the course.

  10. Should any individual remove their consent, the customer / participant and/or the individual will advise Threesticks Pty Ltd via hello@threesticks.com.au and the video will be removed.

  11. Should customer / participant not comply with these terms, Threesticks Pty Ltd will immediately remove access to this video recording and request any copies / downloads (including on internal networks/servers/computers or on the world wide web) to be destroyed / deleted immediately.

Personal Information

Your submission of personal information through the store is governed by our Privacy Policy.

Errors, Inaccuracies and Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. Severability

In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
